A case has been registered against the petitioners for the offence Punishable under Section 108 read with 3(5) B.N.S. 4. Case of the prosecution in brief is that: The allegations as reported on 18.ll.2024 at 10.30 am by the informant, Karampudi Radhakrishna, s/o venkateswara Rao, alleges that hl's brother, the deceased Karampudi Ravindra, aged about 45 years, engaged in the construction business, consumed pesticide poison on 17.ll.2024 near MIC College, Kanchikacherla. He was admitted in Help Hospital, Vijayawada, where he died on the same day at about 8.00 pm while undergoing treatment. All the accused used political influence to register the properties of the deceased in their names and politically harassed him and his family. The harassment intensified over the past four months, driving the deceased to commit suicide. 5. Heard. Perused the record. 6. A perusal of the material available on record goes to show that the deceased made a suicide video, in which he stated thus: (translated into English).... "Hello..eve_ryone! Sri P.Veera Reddy, learned senior counsel appearing on behalfof Sri Sai Saran Chodisetty, learned counsel for the petitioner/A16 has filed the transcription of the vl-deo of deceased and statement that has been made by way of transcription. 8. Learned Assistant Public Prosecutor appearing on behalf of the state, did not dispute the transcription of the video of the deceased. 9. On a perusal of the said statement, it is stated that there are number of debts which he has to repay to the public at large. He expressed the difficulties in continuing his life for the reason that the amounts he gave to others have not been repaid and at the same time he was not in a position to clear the debts and he expressed his difficulty to that extent. The alleged incident is said to have taken place on 17.ll.2024. a-sG>-i-iS, ,-` 10. On a perusal of the said transcription, pr,'ma rae,'e nothing has been alleged so as to attract the offence under section 108 of B.N.S. Thereafter on the next day, the brother of the deceased made certain accusation as against the petitioners herein that they are alleged to have harassed the deceased. It is not known whether the brother of the deceased has been staying together. Earlier there was absolutely no complaint as against the petitioners herein. ll. ln order to attract the offence under section 108 of B.N.S., it is essential that all the ingredients of section 45 of the B.N.S.S. is essentI'al, and no such accusation has been made against any of the accused. ln view of the aforesaid circumstances, this court is inclined to consider the prayer of the petl'tioners for grant of anticipatory bail. 12.
