Digitally signed by R HEMALATHA Location: High Court of Karnataka - 2 - NC: 2025:KHC:17416 CRL.P No. 13866 of 2024 THIS CRIMINAL PETITION IS FILED UNDER SECTION 482 CR.PC (FILED U/S 528 BNNS) PRAYING TO QUASH THE FIR AGAINST THE PETITIONER / ACCUSED IN HULIMAVU POLICE STATION CR.NO.516/2024 FOR THE ALLEGED OFFENCE P/U/S 115(2), 351(2), 352, 74, 78 OF THE BNS 2023, ON THE FILE OF THE IX ADDL. CHIEF JUDICIAL MAGISTRATE, BENGALURU. THIS CRIMINAL PETITION, COMING ON FOR FRESH MATTERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR JUSTICE HEMANT CHANDANGOUDAR ORAL ORDER 1. The petitioner challenges the registration of the First Information Report (FIR) for offences punishable under Sections 115(2), 351(2), 352, 74, and 78 of the Bharatiya Nyaya Sanhita (BNS), 2023. The second respondent lodged the FIR alleging that, upon her refusal to engage in conversation, the petitioner became enraged, threatened her with dire consequences, and used vulgar language. 2. The parties are present before this Court and have filed an application for compounding the offences, stating that they have amicably resolved the dispute among themselves. In terms of the settlement, respondent No. 2 has agreed to withdraw all allegations against the petitioner and has no objection to the quashing of the impugned FIR, with the intent to maintain a cordial relationship and prevent future hostility. 3. The application for compounding is placed on record. - 3 - NC: 2025:KHC:17416 CRL.P No. 13866 of 2024 4. Considering that the parties have amicably resolved the dispute, subjecting the petitioner to further investigation would serve no meaningful purpose. Given the settlement, the probability of the police filing a charge sheet is remote and unlikely. Under these circumstances, the continuation of the investigation would constitute an abuse of the process of law. 5. Hence, I pass the following: ORDER (i) The Petition is allowed. (ii) The impugned first information report in Crime No.516 of 2024 registered by Hulimavu Police Station, Bengaluru is hereby quashed.
