The Court: This is an application for grant of probate of the last Will and Testament dated November 7, 2023 left behind by the above-named deceased. The mother of the testator predeceased him. The deceased is survived by two legal heirs being the wife and one son who have been described in paragraph 9 of the application. The wife has consented to the grant. The son has not come forward to oppose the grant. The department has issued ‘No Caveat Certificate’ indicating that no caveat has been entered against the grant of probate despite issuance of citation. Although, two persons had been appointed as joint executors in the Will, one of them being Ramen Mondal, who is the husband of the other executor, who is the applicant before this Court, has affirmed an affidavit, thereby relinquishing and renouncing his right to act as an executor on the
2 ground that he is working for gain in Italy and is unable to act as the executor. The Will has been proved in common form by one of the attesting witnesses. Having regard to the above and since the file has been placed before this Court by the Registrar Insolvency for grant, upon complete scrutiny by the department, therefore, considering the view of the department, this application for grant of probate is allowed by passing orders in terms of prayer (c) of the petition. Accordingly, PLA/59/2025 stands disposed of.
