As alleged, the Applicant committed rape on the victim girl aged five years. The case before the trial Court is part-heard. The Applicant is in jail for last eight years. However, considering the nature of the allegations, Ms. Raut, the learned Counsel for the Applicant, on instructions, seeks leave to withdraw the aforesaid Bail Application and requested to direct the trial Court to expedite the hearing and dispose of the case within five months. Further, she seeks liberty to file a fresh bail application, if the trial is not concluded within the said period. 3. Leave to withdraw is granted, with aforesaid liberty. 4. Application stands disposed of as withdrawn. 5. It is made clear that this Application is not heard on merits. 6. The trial Court is requested to expedite the hearing of the case and endeavour to dispose of the same within five months. (SHYAM C.
