This is First bail application filed under Section 483 of the Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail to the applicant arrested in connection with Crime No.77/2025 registered at Police Station – Kawardha, District – Kabirdham (C.G.) for the offence punishable under Sections 318(4) of BNS. 2. As per prosecution story, in brief, is that on26.02.2025 the complainant was lodged written complaint against unknown persons was cheated some of Rs.6,66,853/- has online through bank account in the present applicant with without consent of the VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2025.08.05 10:45:39 +0530 2 complainant transfer on such date of incident on 24.02.2025, after police party was started investigation and inquiry to cyber cell and bank statement of complainant, accordingly police officer was collected document and evidence against the present applicant. 3. Learned counsel for the applicant submits that the present applicant has been falsely implicated in this case. He also submits that applicant has not received any amount, the allegation levelled against the present applicant is false and febricated. The applicant is in jail since 08.05.2025, chargesheet has been filed and trial is likely to take some time. Therefore, he prays that the present applicant is entitled for grant of regular bail. 4. On the other hand, the learned State counsel opposes the bail application and submits that the charge-sheet has been filed in the present case before the competent Court. He further submits that the present case is of the nature of online fraud, due to which, complainant has suffered of huge amount 1.e. 6,66,853/- as such, the applicant is not entitled to be released on bail 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. From perusal of the case diary, it transpires that the applicant transferred Rs.6,66,853/- in his bank account without consent of the complainant, present case is of the nature of online fraud, due to which, complainant has suffered of huge amount, therefore, I am not inclined to grant bail to the present applicant. 7. Accordingly, the bail application of the applicant Sanjeev Janghde, involved in Crime No.77 of 2025 registered at Police 3 Station City Kotwali, Mungeli, District- Mungeli (C.G.), for the offence punishable under Sections 111, 311(2), 317(4), 317(5) & 3(5) of Bhartiya Nayay Sanhita is rejected. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9.
