THE HONOURABLE SRI JUSTICE K SREENIVASA REDDY CRIMINAL PETITION No.386 OF 2025 ORDER: This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A5, seeking bail, in Crime No.81/2024 of Chinthapalli Police Station, Alluri Sitharamaraju District. 2. A case has been registered against the petitioner and others for the offences u/Sec.20(b)(ii)(C), 25 r/w 8(c) of the Narcotic Drugs and Psychotropic Substances Act. 3. The case of the prosecution is that on 01.9.2024 at about 6.00 a.m., on receipt of credible information regarding illegal possession and transportation of ganja, S.I of police, along with staff rushed to teak plantation, Chowdupalli Village and Panchayat and conducted vehicle checking. They found two persons coming on a motorcycle from Cherukumpakalu side towards Chintapalli and on seeing police they tried to go back. Then police apprehended them and on interrogation, they disclosed their identity particulars and they are A5 and A6. After that police observed a car coming on the same side and on seeing police the inmates in the car stopped the car and skulked away. Then police verified the car and found 415.328 kgs of ganja. Police seized the ganja and arrested the accused on 01.9.2024. 2 4. Heard. Perused the record. 5. Learned Assistant Public Prosecutor submits that investigation is at nascent stage and some more witnesses are to be examined. 6. A perusal of the material available on record goes to show that huge quantity of ganja i.e. 415.328 kgs was seized and police arrested the petitioner on 01.9.2024. As stated by the learned Assistant Public Prosecutor that the investigation is at nascent stage and hence, this Court is not inclined to grant bail to the petitioner/A5, at this stage. 7.
