Learned counsel for the petitioners would submit that A2 is friend of A1, A3 and A4 are father and mother of A1. Even on the face of the allegations gospel truth, the only offences against A2, A3 and A4 are 506 and of IPC and Section 3(1)(r)(s) of SC/ST (PoA) Act. Petitioners A2 to A4 nothing to do with the alleged affairs between A1 and the female girl. Learned counsel would further submit that the offences alleged against the petitioners/A2 to A4 are punishable with imprisonment of below seven (07) years and a direction may be given to the Police to follow Section 41A of the Code. taken as 509 have Learned Assistant Public Prosecutor would submit that Court may pass appropriate orders directing the police to follow Section 41-A of the code of criminal procedure. 5. Considering the submissions made without going into the merits of the case, since it is an appeal filed for anticipatory bail in a case where the offences under SC/ST (PoA) Act are involved, it is apposite to direct the police to follow the guidelines issued by the Hon’ble Apex Court in Arnesh Kumar v. State ofBihar\ In that view, the Criminal Appeal is disposed of, directing the police to follow the guidelines issued by the Hon’ble Apex Court in Arnesh Kumar (supra) for A2 to A4. Appeal regarding A1 is dismissed as there are allegations made against him for the offences punishable under Sections 417, 4. 6. (2014) 8 see 273 \ 3 a 420, 376, 506, 509 r/w 34 of IPC and Section 3(1)(r)(s) of SC/ST (PoA) This Court makes it clear that the observations made in this appeal is strictly regarding the bail application.
