No.26/2023 filed by the husband under Section 9 of the Hindu Marriage Act for restitution of conjugal rights pending on the file of the Senior Civil Judge and JMFC at Maluru, Kolar District to the Family Court at Bengaluru. 2. Though notice is served on the respondent, no vakalath is filed. 3. Learned counsel for the petitioner submits that the wife is residing at Sarjapura Hobli, Anekal Taluk and the distance between both the places is about 45 kilometers and it is difficult for her to travel from Bangalore to Maluru on each date of hearing. Further, the husband is not paying maintenance to her. - 3 - NC: 2025:KHC:16381 CP No. 505 of 2024 4. Considering the fact that the distance between both the places is 45 kilometers, this Court deems it appropriate to pass the following: ORDER i. M.C. No.26/2023 filed by the respondent pending on the file of the Senior Civil Judge and JMFC at Maluru, Kolar District is withdrawn and the same is transferred to the Family Court, Bengaluru. ii.
