PUBLIC PROSECUTOR The Court made the following ORDER: This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A5, seeking regular bail, in Crime No.172 of 2024 of Devarapalli Police Station, Anakapalli district. 2. A case has been registered against the petitioner herein and others for the offences punishable under Sections 2 20(b)(ii)(C), 25 read with 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ‘the NDPS Act’). 3. Case of the prosecution, in brief, is that, on 19.09.2024, at about 17.30 hours, on credible information, the Sub-Inspector of Police, Devarapalli Police Station, along with his staff and mediators, proceeded to Srirampuram Junction of Devarapalli Mandal, Anakapalli district and found A1 to A3 in possession and illegal transportation of 64 KGs of Ganja in a white colour Maruthi Suzuki Swift Car bearing registration No.AP 23 AA 4156. The contraband along with vehicle and other material was seized under cover of a mediators report and a case has been registered against the accused. Subsequently, based on the confessional statement of A1 to A3, the petitioner herein/A5 was arrested and remanded to judicial custody on 12.11.2024. 4. Heard. Perused the record. 5. A perusal of the material on record goes to show that the contraband allegedly seized from the possession of the accused is 64 Kgs of Ganja, which is a commercial quantity. It is submitted by the learned Assistant Public Prosecutor that investigation is not yet completed and some more accused are to be apprehended. 3 6. In view of the aforesaid facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner/A5. 7.
