Hon’ble Alok Kumar Verma,J. The present Application has been filed by the applicant seeking anticipatory bail in Case Crime No.90 of 2025, registered at Kotwali Jwalapur, District Haridwar. 2. According to the First Information Report dated 02.03.2025, the informant’s sister committed suicide by hanging from a fan on 27.02.2025. Applicant used to blackmail her. His sister had also given money to the applicant several times through online. 1 2025:UHC:5824 3. Heard Mr. M.S. Pal, learned Senior Advocate for the applicant and Mr. Pratiroop Pandey, learned A.G.A. for the respondent. 4. Mr. Pratiroop Pandey, learned A.G.A., has opposed the anticipatory bail application and submitted that a mobile phone of the applicant was taken during the course of the investigation and it was found that the applicant was in continuous touch with the deceased and called her on many times on her mobile phone. The charge-sheet has been filed for the offence under Section 107 of the Bharatiya Nyaya Sanhita, 2023. 5. Mr. M.S. Pal, learned Senior Advocate, contended that the mobile phone of the applicant, aged about 19 years, was taken by the police officer during the course of the investigation but no incriminating evidence has been found in his mobile phone and no material has been produced to show that the applicant in any manner provoked, incited or instigated the deceased to commit suicide. 6. Mr. M.S. Pal, learned Senior Advocate, further submitted that the applicant does not have any criminal antecedents. He is a permanent resident of District Haridwar, therefore, there is no likelihood of his 2 2025:UHC:5824 absconding. Charge-sheet has already been filed, therefore, there is no chance of tampering with the evidence. Applicant was granted interim bail on 18.03.2025, and, the conditions of the interim bail have not been violated by him. 7. Personal liberty under Article 21 of the Constitution of India is very precious fundamental right and it should be curtailed only when it becomes imperative according to the peculiar facts and circumstances of the case. 8. Having heard the submissions of learned counsel for the parties and keeping in view of the facts and circumstances of the case, without commenting on the merits of the case, the present Application, filed for anticipatory bail, is allowed and order dated 18.03.2025, granting interim bail to the applicant, is made absolute. It is directed that in the event of arrest of the applicant Rudraksh Verma, he shall be released on anticipatory bail on executing a personal bond of Rs. 30,000/- and two reliable sureties, each of the like amount, to the satisfaction of the Arresting Officer, subject to the following conditions:- (i) Applicant shall attend the trial court regularly and he shall not seek any unnecessary adjournment; 3 2025:UHC:5824 (ii) Applicant shall not directly or indirectly make any inducement, threat or promise to any person, acquainted with the facts of this case; (iii) Applicant shall not leave the country without the previous permission of the trial court. 9. It is made clear that if the applicant misuses or violates any of the conditions, imposed upon him, the prosecution agency will be free to move the Court for cancellation of the anticipatory bail. ___________________ ALOK KUMAR VERMA, J.
