The Circle officer, Khelari, District- Ranchi 3. CCL, North Karanpura Area, Dakra, Ranchi …. … Respondents CORAM: HON'BLE MR. JUSTICE RAJESH SHANKAR For the Petitioners : Mr. Avishek Prasad, Advocate For the Resp. Nos. 1 & 2 : Mr. Abhijeet Anand, AC to SrSC-I For the Resp. No. 3 : Mr. A.K. Das, Advocate Mr. Vineet Sinha, Advocate Order No. 02 Dated: 29.07.2025 The present writ petition has been filed for quashing the order dated 20.12.2024 (Annexure-1 to the writ petition) passed by the General Manager (L&R), Central Coalfields Limited, Darbhanga House, Ranchi in compliance of the order dated 18.09.2024 passed in W.P.(C) No. 3171 of 2024 whereby the claim of the petitioners with respect to payment of compensation in lieu of acquisition of land appertaining to plot nos. 465, 466, 467, 468, 469, Khata No. 31, Village- Bishrampur, P.O. & P.S.- Khelari, District- Ranchi has been rejected. 2. Mr. A.K. Das, learned counsel for the respondent no. 3 raises an objection with regard to maintainability of the writ petition on the ground that the petitioners have statutory remedy by filing a claim case before the Tribunal constituted under Section 14(2) of the Coal Bearing Areas (Acquisition & Development) Act, 1957 (in short, “the Act, 1957”). 2 3. Having heard learned counsel for the parties and considering that the petitioners have efficacious/statutory recourse of filing a claim case before the Tribunal constituted under Section 14(2) of the Act, 1957 with respect to compensation for acquisition of the land in question, I am not inclined to entertain the present writ petition and the same is accordingly dismissed as not maintainable. 4. The petitioners are, however, at liberty to take the aforesaid statutory recourse against the impugned order dated 20.12.2024. (Rajesh Shankar, J.) Ritesh/
