Charge sheet is filed against the petitioner for the offence punishable Section 302 of Indian Penal Code, 1860 [for short, 'IPC'].
2. It is the case of prosecution that deceased was working as a Cashier in one Manjunatha Tiffin Centre run by CW.1/complainant. Accused was working as cleaner in the said Tiffin Centre. The deceased was frequently abusing the accused using foul language. Hence, on 18.06.2024 between 5.40 a.m and 6am, accused

assaulted the deceased with a gym rod on his head and committed his murder.
3. The victim was initially shifted to Kaveri Hospital for treatment and from there, he was taken to Kasturba Hospital, Manipal and again to Government Hospital, Kundapura. However, he succumbed to the injuries on 13.07.2024 at about 8.15pm.
4. The prosecution is mainly relying on the statement of CW.6, who saw the accused coming out of the room of deceased, locking the room and going away, keeping the door key at the window. CW.9 has stated that he saw the accused near the building parking lot and leaving the premises in a hurried manner. The prosecution is also relying on the recovery of blood stained clothes and steel gym rod at the instance of accused.

Learned counsel for the petitioner submits that he may be permitted to renew his application before the

Sessions Court after recording of the evidence of CWs.1, 6 and 9 and at present, he will not press the petition. In the light of the above submission, petition is dismissed as withdrawn reserving liberty to the petitioner to file a bail petition before the Sessions Court after the examination of CWs.1, 6 and 9. No opinion is expressed on the merits of the case.
