This application under Section 482 of BNSS, 2023 has been filed by the petitioner, namely, Johiran Begum, seeking pre-arrest bail in connection with Page No.# 2/3 Nagarbera P.S. Case No.24/2025 registered under Sections 61(2)/87/109(1)/336(3) of BNS, 2023. 3. The case arose out of an FIR dated 21.03.2025. The petitioner is on interim bail granted by this Court vide order dated 22.09.2025. 4. The gist of the allegations in the FIR, wherein five accused persons have been named – is that the informant victim was kidnapped in a vehicle and eventually taken to Manipur and kept at a place from where she manage to escape and contact a local village headman who helped the victim to escape through Imphal and finally reached Guwahati. 5. Case Diary as called for is received and perused. 6. One FIR named co-accused who happens to be the husband of the present petitioner was granted default bail 22.09.2025 by another order. 7. The learned counsel for the petitioner points out that FIR was lodged after about a month of the alleged incident. However, from the narration in the FIR, I find that only after she could escape from her alleged detention in Manipur, she could file the FIR. 8. It appears that pursuant to the interim protection granted by this Court, the petitioner had appeared before the I.O. and her statement has already been recorded. Furthermore, it appears that the main accused of the case i.e. accused No. 5, who is not before this Court. 9. Having regard to the above, the prayer for bail is allowed. The interim order dated 22.09.2025 is hereby made absolute subject to the same conditions as mentioned in the interim order itself as applicable as on today. 10.
