CORAM: HONOURABLE MR. JUSTICE SANDEEP KUMAR ORAL ORDER 2 05-05-2025 Heard learned counsel for the petitioner and learned counsel for the State.
2. By way of this writ application, the petitioner has prayed for the following reliefs:-
“I. For issuance of a writ, order or direction the nature of MANDAMUS directing and commanding the Respondent State to conduct fair, proper, judicious investigation pertains to Karja PS- Case No. 199/2018 in fair and impartial manner by an independent investigation team. II. For issuance of a writ, order or direction the nature of MANDAMUS to direct the respondent authorities to make fair and

WJC No.785 of 2025(2) dt.05-05-2025 2/3 proper investigation against the private respondent no-5 and other persons involved and further be please to direct to the respondent authorities to take necessarily sanction of the concerned authority for prosecution as deem fit under the law. III. For issuance of a writ, order or direction the nature of PROHIBITION directing and commanding the respondent police officers for attaching not the immovable/movable properties which belongs to the petitioner in connection with. IV. For issuance of a writ, order or direction the nature of MANDAMUS directing and commanding the respondent police officers to take appropriate action against the investigation officer for not securing C.C.T.V footage even after making representation to the concerned authorities. V. For issuance of a writ, order or direction the nature of MANDAMUS directing and commanding the Respondent State to conduct proper investigation considering the oral, documentary evidence, CCTV Footage, Mobile CDR and Locations of the petitioner mobile phone and other relevant evidence.”

For the aforesaid reliefs, as prayed by the petitioner, he is given liberty to approach the Senior Superintendent of Police, Muzaffarpur with an application for the reliefs sought above and if the Senior Superintendent of Police, Muzaffarpur finds substance in the application of the petitioner, he will pass appropriate orders in this regard.
4. With the aforesaid observation, this application is
disposed of.
5. It is made clear that this Court has not expressed
