Respondent-plaintiff had filed a suit for declaration that he was entitled to pay scale of Rs.1640-3000 instead of Rs.1050-2100 w.e.f. 24.01.1986. The suit was filed in the year 1991 and was dismissed and the appeal filed against the same by the respondent/plaintiff was allowed and the judgment of the trial Court was set aside and the suit filed by the respondent-plaintiff was decreed. 2. A perusal of the paper-book would show that on 15.09.1998, the interim order passed in favour of the present appellant was vacated. 3. Learned counsel for the appellant has submitted that subsequently, the respondent-plaintiff had retired and had even died, thus, the present appeal be disposed of as having been rendered infructuous. 4.
