The applicant has preferred this First Bail Application under Section 483 of the BNSS in connection with Crime No. 11/2025, registered at Police Station – Ghumka, District - Rajnandgaon (C.G.) for the offence punishable under Sections 317(2), 317(4), 317(5), 111 & 3(5) of the Bhartiya Nyaya Sanhita, 2023. 2. As per prosecution story in brief, it is alleged that the accused persons including present applicant were engaged in illegal money VAIBHAV SINGH Digitally signed by VAIBHAV SINGH Date: 2025.07.22 12:53:26 +0530 2 transactions through cyber fraud. Applicant in collusion with other co- accused persons have used illegal money by making unethical transactions knowing that it is stolen money in order to financial gain directly or indirectly by depositing Rs.9,58,718 in his account and transferring it to other co-accused persons. 3. It has been argued by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated in this case. He further submits that the applicant has neither entered in the house nor committed stolen of any article of the complainant’s house. He further submits that the applicant is neither holding bank account which can be operated as mule account, nor his identity proof has been used with his consent to open any mule account in any of the bank branches to earn any kind of profit through illegal or unfair means and he is in jail since 08.02.2025, conclusion of the trial may take some time, therefore, he prays for grant of regular bail to the applicant. 4. On the other hand, the learned counsel for the State opposes the bail application. 5. I have heard learned counsel for the parties and perused the material available on record. 6. Considering the facts and circumstances of the case, the nature and gravity of the offence, and the material available in the case diary particularly the fact that the present applicant is a member of a group involved in illegal money transactions through cyber fraud, and that the applicant knowingly used the proceeds of crime by making unethical transactions with stolen money and further, in view of the 3 fact that the bail applications of co-accused person has already been rejected by this Court, I am of the opinion that this is not a fit case for grant of regular bail to the applicant. 7. Therefore, the bail application filed by the applicant/accused – Sanjay Kumar Sahu, involved in Crime No. 11/2025, registered at Police Station – Ghumka, District - Rajnandgaon (C.G.) for the offence punishable under Sections 317(2), 317(4), 317(5), 111 & 3(5) of the Bhartiya Nyaya Sanhita, 2023, is rejected. 8.
