It is stated that the respondent No.1 died during the pendency of the appeal and in view of the same, the appellant is not interested in pursuing the appeal. The learned counsel for the respondents states that he could not receive any instructions from the respondent No.2 i.e., mother of respondent No.1. In the said circumstances, we are constrained to dismiss the appeal for non–prosecution. 2. Accordingly, the C.M.A., is dismissed for non–prosecution. No order as to costs.
