Heard learned counsel for the Petitioner and learned counsel appearing for the Opp. Parties. 3. Petitioner has filed the present writ petition inter alia with the following prayer:- “In the facts and circumstances of the case the humble petitioner fervently prays this Hon'ble Court to be graciously pleased to issue notice to the Opp. parties, call for relevant records and after hearing the Counsel of parties, issue a writ in the nature of Mandamus commanding the Opp.parties particularly to the Opp.party No. 1& 3, Commissioner-Cum-Secretary, Health & Family Welfare Dept., Odisha & Chief District Medical Officer & PHO, Keonjhar to count the service seniority of the petitioner from the date of initial appointment/regularization of candidates selected in the walk-in-interview on 29.05.2013 with the petitioner i.e., from 31.07.2013 and 18.04.2019 notionally for the purpose of promotion, financial & other service benefits within the stipulated time. And/or pass such other order or direction as deems fit and proper in the interest of justice, Page 2 of 2. And for this act of your kindness, the humble petitioner shall as in duty bound, ever pray.” 4. However, taking into account the claim raised in the present Writ Petition, liberty is granted to the Petitioner to make a fresh representation before Opp. Party No. 3 by enclosing all the relevant documents and citations in support of his claim, if any, within a period of three (3) weeks hence. 5. It is observed that if such representation is filed within the aforesaid time period, Opp. Party No. 3 shall do well to take a lawful decision on the same within a period of three (3) months from the date of receipt of such representation. The order so passed by Opp. Party No. 3 be communicated to the Petitioner. 6. With the aforesaid observation and direction, the Writ Petition is disposed of.
