PUBLIC PROSECUTOR The Court made the following order: This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the 2 2 petitioner/A3, seeking regular bail, in Crime No.48 of 2024 of G. Madugula Police Station, Alluri Sitharama Raju district. 2. A case has been registered against the petitioner herein and others for the offence punishable under Section 20(b)(ii)(C) read with 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ‘the NDPS Act’). 3. Case of the prosecution, in brief, is that, on 30.10.2024, at about 08.00 am, on credible information, the Sub-Inspector of Police, G.Madugula Police Station, along with his staff and mediators, proceeded to MRO Office Junction, G.Madugula Panchayath, G. Madugula Mandal, Alluri Sitharama Raju district and found A1 to A3 in possession of 57 Kgs of Ganja. The contraband was seized under cover of a mediators report and a case has been registered against the accused. 4. Heard. Perused the record. 5. A perusal of the material on record goes to show that the contraband allegedly seized from the possession of the accused is 57 Kgs of Ganja, which is a commercial quantity. It is submitted by the learned Assistant Public Prosecutor that the investigation is not yet completed and some more witnesses are 3 3 to be examined. He further submitted that the petitioner herein is involved in seven (7) other cases relating to same offences. In view of the aforesaid facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner/A3. 6.
