---- 02/28.11.2025 Heard learned counsel appearing for the petitioner as well as the learned counsel appearing for the State.
2. The petitioner is apprehending his arrest in connection with Telaiya P.S. Case No.75 of 2024, for the alleged offences registered under Sections 270, 272, 273 and 290 of Bharatiya Nyaya Sanhita, 2023 and Section 47(a)(f) of Excise Act pending in the Court of learned Additional Chief Judicial Magistrate, Koderma.

Learned counsel appearing for the petitioner submits that the allegation is made that 100 liters of country made mahuwa liquor was recovered from the house of one Bhakhru @ Rakesh Yadav. He further submits that only on suspicion the name of the petitioner has come in the FIR.

Considering that the name of the petitioner has come on the secret information and the name of the person, who has taken the name of the person, is not disclosed in the FIR and the said recovery was made from the house of Bhakhru @ Rakesh Yadav and nothing incriminating has been recovered from the possession of the petitioner, I am inclined to provide anticipatory bail to the petitioner.

Accordingly, the petitioner, above named, is hereby directed to surrender before the learned Court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned Additional Chief Judicial Magistrate, Koderma in connection with Telaiya P.S. Case No.75 of 2024, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
