Ms. Sabrina Parveen …for the Petitioner Ms. Faria Hossain Mr. Asif Dewan ...for the State Report dated 26th August, 2025 is taken on record. Learned counsel appearing on behalf of the petitioner submits that petitioner is in custody for about 83 days since 12.05.2025. She further submits that the petitioner was arrested on the basis of a co-accused statement and he was taken to six days police custody and nothing was recovered from his possession and he has no criminal antecedence and accordingly he prays for bail on any terms and conditions. Learned counsel appearing on behalf of the State placed the report dated 26th August, 2025 and submits that investigation reveals that the petitioner was in constant conversation from 23rd March to 30th March, 2025 with the co-accused persons from whom huge quantity of narcotic 2 substance was recovered and that that the investigation is still going on. Having heard learned counsel appearing on behalf of the petitioner and the State and that the investigation is still in progress and that prima-facie there are materials in the case diary against the present petitioner and as such he has failed to overcome the rigour of section 37 of the NDPS Act at this stage and for which his prayer for bail is considered and rejected. Accordingly, CRM (NDPS) 991 of 2025 is disposed of. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
