Present petition has been filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of pre-arrest bail to the petitioner in FIR No.0040 dated 19.02.2025, under Sections 20 and 25 of Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ‘NDPS Act’), registered at Police Station Nigdhu, Karnal, District Karnal. 2. Allegations are that 714 grams charas have been recovered from co-accused, namely, Vikram @ Pinda, Dharmender @ Davender and Ramkaran Puri @ Rinku; who allegedly purchased the same from present petitioner. 3. Contends that petitioner has been falsely implicated in this case. CRM-M No. 15495-2025 2 Davender and Ramkaran Puri @ Rinku. Further contends that there is no material available with the police regarding his complicity. 4. Per contra, learned State counsel while referring to para No.9 of the status report dated 26.03.2025 filed on 28.03.2025, submits that co- accused Vikram @ Pinda, Rinku @ Ramkaran Puri and Dharmender had purchased 1 kg. Charas (Sulfa) from the petitioner for Rs.60,000/- and co- accused Rinku @ Ramkaran Puri talked with petitioner on his mobile 98978-02033. Further submitted that CDR with location of mobile no. 9897802033 of petitioner from 18.01.2025 to 20.02.2025 and CDR with location of mobile no.8059129953 of co-accused Ramkaran Puri @ Rinku from 18.01.2025 to 19.02.2025 have been obtained from Cyber Cell, S.P., Office Karnal and according to which petitioner had talked twice with co- accused Ramkaran Puri @ Rinku on 18.01.2025; twice on 12.02.2025; thrice on 14.02.2025 and again on 15.02.2025 shown in CDR with location of mobile no.8059129953 of Ramkaran Puri @ Rinku.
Also submitted that location of co-accused Ramkaran Puri @ Rinku has been shown in native village-Titarwala of petitioner from 6:00 P.M. to 6:47 P.M on 14.02.2025; thus, his custodial interrogation is required to unearth the mode and manner of alleged crime. 5. Heard learned counsel for the parties and perused the paper- book. 6. After hearing both sides and upon perusal of police papers, prima facie, it is discernible that co-accused procured the alleged contraband from petitioner; thus, his complicity is well apparent. In such a scenario, custodial interrogation of the petitioner would be very much necessary to know the true facts.
