The petitioner claims that he is entitled to payment of salary during the suspension period. A representation in this regard has been made to the competent authority but to no avail. The only prayer made by Shri Kedar Nath Mishra, learned counsel for the petitioner is that the representation of the petitioner may be decided within a stipulated period of time. Shri Manoj Nigam, learned counsel for the respondents submits that the matter requires factual determination as per applicable law by the competent authority in the first instance. However, he fairly contends that the service benefits/salary claims are liable to be decided by the competent authority in a reasonable time frame. In light of the submissions made at the Bar and without going into the merits of the case, the respondent no. 2 is directed to decide the representation of the petitioner for payment of salary during the suspension period as per law within a period of three months from the date of receipt of a certified copy of this order along with a fresh copy of the representation. It is clarified that this Court has not gone into the veracity of the assertions made in the writ petition nor has judged the claim of the petitioner on merit. It is for the competent authority to do so after independent application of mind and in accordance with law. With the aforesaid direction, the writ petition is finally disposed of.
