ORDER:
1. This criminal petition undersection 482 of the BNSS is filed by the petitioner/A8 to grant anticipatory bail in connection With crime No.231 of 2024 of Sr'lkakulam Town Police Station Of srikakulam District for the offences punishable under Sections 8(c) read with 20(b)(ii)(B), 25 of the NDPS Act.
2. Heard arguments of Sri N.Bharath Simha Reddy, the
learned counsel for petitioner and the learned Assistant Public Prosecutor for respondent/State. 3. From the record, it iS Seen that On 07.09.2024, several accused were arrested and a total quantity of 3 Kgs of Ganja Was seized and those who were arrested were remanded to judicial custody. Investigation is still under progress. 4. The present petitioner iS Stated tO be A8. He seeks Pre- arrest bail. Earlier, he filed Crl.P.No.8600 of 2024. This court by an order dated 16.12.2024 dismissed the Same On a View that in NDPS cases, pre-arrest bail may not be granted. 5. ln this renewal bail Petition, additional grounds are urged. According to prosecution, during -Investigation, it Was found that for the purpose of purchasing Ganja, this Petitioner, -#de7
\ transferred Rs.5,000/- to Other accused On 18.08.2024 and therefore he is part of the alleged crime. 6. lt iS undiSPuted that nO Part Of the COntraband Was Stated tO be 'ln possession of this pet-ltioner. lt is also undisputed that the petitioner is a student pursuing his education. ln sah,I/ I,-roj shaj* v. Considering the abOVe faCtS, this COurf iS Of the View that ng. custodial interrogat-Ion does not seem necessary. Hence, Prayer 'ls granted. 8. ln the result, this Criminal Pet|lt'lOn iS a"owed -ln the following terms.. The petitioner iS directed tO join the investigation. [n the event of his arrest, the petitioner/A8 sha" be enlarged on bail on executing a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) With two sureties of the like sum each to the satisfaction of the investigating officer and one such surety should be one of his parents. 3. The Petitioner Shall mark h-lS attendance before the investigating officer on lSt and 15th of every month between 10.00 AM and 1.00 PM for a Period Of three months Or till filing of the charge sheet whichever -ls earlier.
