Heard the parties.
Petitioner has been made accused in connection with Lawalong P.S. Case No. 52 of 2024 corresponding to POCSO Case No. 83 of 2024 for the offences registered under sections 87, 96 and 3(5) of the Bharatiya Nyaya Sanhita, 2023 and section 8 of POCSO Act and charge has been framed for the said offences, pending in the court of learned Special Judge, POCSO, Chatra. Bail application of the petitioner was earlier rejected by this Court vide B.A. No.1451 of 2025 by the order dated 27.03.2025. Petitioner is alleged to have enticed away the minor daughter of the Informant to leave her lawful guardianship with the intention to marry her. From the perusal of the statement of the victim recorded under section 183 of the B.N.S.S., it appears that both the petitioner and the victim had established consensual physical relationship. It was submitted that this appears to be a case of adolescent love affair between the parties. It was further submitted that petitioner is in custody for about one year four months. In view of the aforesaid facts, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of learned Special Judge, POCSO, Chatra, in connection with Lawalong P.S. Case No. 52 of 2024 corresponding to POCSO Case No. 83 of 2024.
