(Oral) As per the observations made in the order dated 17.02.2026, despite service, the respondent did not make appearance on that date. Even today, he has not made appearance. As such, the respondent is proceeded against ex parte. Counsel for the applicant heard. The applicant-wife has filed the present application for seeking transfer of the petition under Section 13 of the Hindu Marriage Act i.e. HMA/1116/2025, titled ‘Gulshan Kumar Vs. Ekta Goel’, filed by the respondent-husband, pending in the Family Court, Gurugram and she seeks transfer of the same to the Court of competent jurisdiction at Kaithal. It is submitted by the counsel for the applicant that the marriage between the parties to the lis, had taken place on 02.12.2022, but no child was born from the said wedlock. 2 TA-1495-2025 between the parties, as a result whereof, they are residing separate. The applicant is herself working as ‘Clerk’ in Excise and Taxation Department, Government of Haryana and she is presently posted at Kaithal. She has filed the petition under the Protection of Women from Domestic Violence Act, which is pending in the Courts at Kaithal, at appearance stage. Besides the same, the applicant had got lodged an FIR bearing No.27 dated 22.06.2025, under Sections 115, 316(2), 351(2) and 85 of Bharatiya Nyaya Sanhita, at Women Police Station, Kaithal and the respondent is facing trial, relating to the same, in the Courts at Kaithal. The distance between the two places is stated to be 200 kms. on one side. In view of the submissions aforesaid, it is pertinent to mention that the applicant is working as a ‘Clerk’ and as such, is having independent source of earning. However, various other circumstances, spelt out from the material brought on record, also ought to be taken into consideration. The foremost, to be considered is about the respondent having not come forward to resist the application. In view of the aforesaid fact situation and taking into
consideration the same and further about two other litigations, arising from the broken marriage to be already pending in the Courts at Kaithal, more particularly, the criminal case, wherein the respondent is required to make appearance on each and every date of hearing, as well as taking into
consideration the distance between the two places, the transfer application is allowed and the petition under Section 13 of the Hindu Marriage Act i.e. HMA/1116/2025, titled ‘Gulshan Kumar Vs. Ekta Goel’, filed by the respondent-husband, stands transferred from the Family Court, Gurugram, to SONU 2026.03.12 15:36 I attest to the accuracy and authenticity of this document
3 TA-1495-2025 the Court of competent jurisdiction at Kaithal. The requisite record of the aforesaid case be sent by the Family Court, Gurugram, to the District and Sessions Judge, Kaithal. Learned District and Sessions Judge, Kaithal, shall assign the said petition to the Family Court, Kaithal. Even, the parties are directed to appear before the Family Court, Kaithal, within a period of one month from today onwards.
