Learned counsel for the petitioners submits that the semi-pucca construction raised by the petitioners is in Khatian No.669, Dag No.262 whereas the order impugned passed by the Sub-Divisional Officer is in respect of Khatian No.108, Plot No.262 (LR & RS). The petitioners submitt that no construction has been raised by them in Khatian No.108. It appears from the order impugned as well as the report submitted by the State that the contention of the petitioners was considered by the Sub-Divisional Officer in dealing with the issue and sufficient reason has been assigned in the said order for arriving at the conclusion. There is no infirmity/illegality in the said order which requires interference by this Court. 2 In view of the above, this Court is inclined to hold that the writ petition being devoid of any merit, is dismissed. The Sub-Divisional Officer, Canning, being the 3rd respondent herein, is directed to take necessary steps in terms of the order impugned dated 8th September, 2025 and cause demolition of the structure in Khatian No.108, Plot No.262 (LR & RS), JL No.74, Mouza Kanthalberia. There shall, however, be no order as to costs. The parties are at liberty to communicate the gist of the order to the Sub-Divisional Officer at once. The parties shall act on the server copy of the order duly downloaded from the official website of this Court. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Suvra Ghosh, J.)
