Hon'ble Rohit Ranjan Agarwal,J. The petitioner before this Court has already challenged the award made by Motor Accident Claims Tribunal before this Court through F.A.F.O. Defective No. 1119 of 2024 in which notices have already been issued on delay condonation application. The present writ petition has been preferred against issuance of recovery certificate dated 15.02.2025. Once the award is under challenge before this Court in F.A.F.O. Defective No. 1119 of 2024, a separate writ petition under Article 226 of Constitution impugning the recovery certificate is not maintainable. The writ petition is dismissed with a liberty to petitioner to approach the appellate court by moving necessary application.
