Ltd. -versus- Sri Subhranil Ray Mr. Sujit Bhattacharyya … for the petitioner This application under Article 227 of the Constitution of India is at the instance of the opposite party in a complaint case and is directed against an order being no. 16 dated 19th June, 2025 passed by the District Consumer Dispute Redressal Commission, Kolkata Unit III (South), Alipore in Complaint Case No. EA/68/2023 arising out of CC/96/2021. The learned advocate appearing for the petitioner submits that the District Consumer Redressal Commission passed a judgement dated 15th March, 2023 in Complaint Case No. CC/96/2021 directing the petitioner herein to refund a particular sum of money together with interest. He submits that such an order was passed ex parte. The said order was put into execution and by the order impugned the Officer-in- Charge of the local police station was directed to execute the warrant against the petitioner and to file its report. He submits that the petitioner is ready and willing to comply with the directions contained in the order dated 2 15th March, 2023 passed in Complaint Case No. CC/96/2021. In the light of the submissions made by the learned advocate for the petitioner, C.O. 2887 of 2025 stands disposed of by giving liberty to the petitioner to approach the District Consumer Dispute Redressal Commission in EA/68/2023 by making an appropriate application in that regard. If such an application is filed the learned District Consumer Dispute Redressal Commission shall consider the same in accordance with law. Let such application be filed on or before August 18, 2025. The order impugned shall remain stayed till August 18, 2025. It is, however, made clear that in the event no application is filed within the time limit indicated hereinbefore this order of stay shall stand automatically vacated. There shall be, however, no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
