The petitioner has filed this petition for a direction to the respondent authorities to consider her claim for grant of pension and other service benefits in the light of order dated 26.05.2018 issued by the State 2 Government and also in the light of order dated 26.02.2015 passed by the Division Bench of this Court in Writ Appeal No.281 of 2013 (Lakhanram Sahu & Others Vs. State of Chhattisgarh & Others, and connected matters) 2. Learned counsel for the petitioner would submit that the petitioner stood retired from the post of Peon with the respondent Department on 30.11.2023. Initially the petitioner was appointed in the year, 1999 and she continued with the respondent department till her retirement and she attains the status of permanent employee with the department and therefore she is entitled for retiral dues and pension from the department, yet the said benefits have not been extended to her. He would rely upon order dated 26.02.2015 passed in Writ Appeal No.281 of 2013 (Lakhanram Sahu & Others Vs. State of Chhattisgarh & Others, and connected matters). 3. On the other hand, learned counsel for the State would submit that though the petitioner stood retired w.e.f. 30.11.2023, however, due to bifurcation of district Raigarh into Sarangarh-Bilaigarh, complete service records of the petitioner is not available with the authorities at Sarangar-Bilaigarh on account of which entitlement of service benefits and pension to the petitioner could not be determined. He would further submit, on instruction, that the authorities will decide the claim of the petitioner within an outer limit of two months from today. 4. I have heard the counsel appearing for the parties and perused the material annexed with the petition. 5. Considering the submissions made by the counsel for respective parties and also considering the grievance of the petitioner, the respondent No.1 is directed to take a decision on the representation of 3 the petitioner dated 30.05.2025 within an outer limit of two months from today in accordance with law and applicable rules holding the field. The petitioner is directed to produce a copy of this order to respondent No.1 within a week from today. 6. With the aforesaid observation, the Writ Petition stands disposed of.
