Mr. Deepak Agarwal, Adv. …for the petitioner. The Court:- This is an application for grant of Probate of the last Will and testament dated January 14, 2009, left behind by the above-named deceased. The husband of the testatrix pre-deceased her. The testatrix is survived by 3 legal heirs (being one son and two daughters). The son is the executor appointed in the Will and the applicant herein. The two daughters have consented to the grant by filing Affidavits of Consent. The Will has been proved in common form by one of the attesting witnesses. Having regard to the above and since the file has been placed before this Court by the Registrar Insolvency for grant upon complete scrutiny by the department, therefore, considering the view of the department, the application for grant of probate is allowed by passing orders in terms of prayer (a) of the application.
