PUBLIC PROSECUTOR The Court made the following: JUDGMENT:- The Respondent No.1/ Accused was tried in C.C.No.143 of 2006 on the file of the Court of the III Metropolitan Magistrate, Visakhapatnam. Vide order, dated 18.05.2007, the complaint filed by the complainant was dismissed on the ground that batta was not paid for issuance of proclamation under Sections 82 and 83 of Cr.P.C. It is further observed that the complainant is called and there is no representation on his behalf. Against the said dismissal of the complaint, the complainant preferred the present Criminal Appeal before this Court. 2. Pending the Criminal Appeal, a Memo has been filed by the learned counsel for the appellant stating that the appellant has no interest to prosecute the case for further hearings and hence, he intends to withdraw the present Criminal Appeal. Further, for non appearance of the appellant herein, earlier this Court issued bailable warrant against the appellant. Today, the appellant is present before this Court and submitted that he has no interest to prosecute the case. 3. In view of the aforesaid reasons, the Criminal Appeal No.1351 of 2007 is dismissed as withdrawn. 4.
