This Court, vide order dated 22.01.2025, passed in MCRC No. 7274 of 2024, while allowing the bail to the petitioner, namely, Sushil Kumar Sahu, had expressed its trust that the trial Court should make an earnest endeavor to conclude the trial expeditiously in accordance with law, preferably within a period of 06 months from the date of receipt of a certified copy of the order, if there was no legal impediment. The learned Special Judge (NDPS Act), Saraipali District - Mahasamund (C.G.), vide his request letter dated 03.07.2025, has requested an extension of more time that After receiving the order of the Hon'ble High Court, the case has been fixed for pre-charge arguments on 24.01.2025, 27.01.202, 22.02.2025, 04.03.2025, 28.03.2025. I have assumed charge as Special Judge (NDPS) on 26.03.2025. The case was first placed before me on 28.03.2025 for consideration at the stage of pre- charge arguments. The case was fixed for pre-charge arguments on 07.04.2025. Charges could not be framed due to the absence of the accused. Charges were framed on 16.04.2025 and the date 21.04.2025 was fixed for trial. On presentation of the trial program, the dates were fixed for prosecution evidence on 02.05.2025 03.05.2025 14.05.2025 16.05.2025 16.06.2025 17.06.2025 18.06.2025. Summons/bailable warrants/arrest warrants are being issued continuously to the witnesses, but evidence could not be recorded due to the absence of prosecution witnesses. The case has been again fixed for prosecution evidence on 24.07.2025, 25.07.2025 and 26.07.2025 and a summative and bailable warrant has been issued to the prosecution witnesses through the Superintendent of Police, Mahasamund. As per the trial program, the evidence of 17 witnesses is yet to be recorded in the case. Honorable Sir, in this court, 214 special session cases of NDPS, 316 civil and criminal cases, a total of 530 cases are pending. Efforts are being made to resolve the cases quickly by giving dates next to each other. After recording of evidence of 17 prosecution witnesses in the case, the accused statement, final arguments and defence evidence are to be taken, due to which it does not appear to be possible to resolve the case within the prescribed time limit as per the order of the Honourable High Court. 4. Therefore, it is requested to the Hon’ble Sir that time is required for 3 proper resolution of the matter, hence please provide additional time. Hence, he prays for more time to conclude the trial. 5. The request appears to be reasonable. The concerned trial Court is directed to conclude the trial as early as possible, preferably within a further period of three months from today. 6. Accordingly, this CRMP stands disposed off with the aforesaid direction. 7.
