JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 2 06-05-2025 Heard learned counsel for the petitioner and learned A.P.P for the State. 2. The petitioner has preferred this application for grant of regular bail in connection with Danapur P.S. Case No. 116 of 2025 dated 05.02.2025 registered for the offences punishable u/ss 303(2) and 317 (2) of the BNS. 3. As per the prosecution case, tractors overloaded with sand illegally were passing through main road Pethiya Bazar. On seeing the police party, the drivers/liners were tried to flee away but police chased and apprehended them including the petitioner. Patna High Court CR. MISC. No.26020 of 2025(2) dt.06-05-2025 2/2 4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner. The petitioner is the driver of one of the vehicles. Similarly situated co-accused has already been granted bail by the co-ordinate bench of this court vide order dated 30.04.2025 passed in Cr. Misc. No. 24419 of 2025. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 06.02.2025. 5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner. 6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above- named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Danapur, Patna in connection with Danapur P.S.
