Also heard Mr. S.S. Baghel, learned Panel Lawyer for respondent / State. 2. The petitioner has filed this present petition praying for following relief:- “It is therefore, prayed that this Hon'ble Court may kindly quash the complaint (Annexure P-1) registered as Criminal Case No. 721/2008 and further proceedings pending in the Court of Judicial Magistrate First Class, Raipur in the said case, and kindly be please to set aside the order dated 5.04.1988 08.05.1998 (Annexure P-2), in the interest of justice.” 3. As the petitioners counsel were not aware of the proceedings of the trial pending against the petitioners, hence a report was called from the trial Court as to whether the matter is still subjudice before the trial Court or not. 4. From the query made, the orders dated 1.12.2018 and 03.12.2018 have been placed before this Court, perusal of which shows that vide order dated 03.12.2018, the learned Magistrate as per the direction of this Court that the cases pertaining more than 10 years pending may 3 be decided on priority basis, as the present case was pending for very long period, hence accused Rajesh Kumar Bangani and Dattakshey R. Joshi have been discharged and the matter has been consigned to record against the abovenamed accused persons. However, so far as the petitioners herein are concerned, they are still stated to be absconding, but they have filed the present petition. 5. Considering the same, as the matter has been consigned to record, the petitioners are directed to move an appropriate application before the trial Court concerned for reviving the proceeding, which may be disposed of in accordance with law and brought to its logical end. 6.
