K KRISHNABUSHANCHOWDARY The Court made the following common order: SRS,J I.A.No.1 in / and W.P.No.35403 of 2022 The above writ petition is filed impugning the order dated 17.10.2022 in C.P.No.49 of 2022, passed by the Andhra Pradesh Real Estate Regulatory Authority, Vijayawada. 2. Interim stay of the impugned order, insofar as the imposition of penalty against the petitioner is concerned, was granted on 02.11.2022. 3. Pending the writ petition, the petitioner and respondent No.2 entered into a compromise. 4. I.A.No.1 of 2025 is filed by the petitioner and respondent No.2, under Order XXIII Rule 3 of the Code of Civil Procedure, 1908, to record compromise in terms of memorandum of compromise, entered between the petitioner and respondent No.2/complainant and to pass an order in terms of the compromise. 5. The Manager of the petitioner, as well as respondent No.2, appeared before the Court. The learned counsels identified the respective parties. 6. This Court enquired, the Manager of the petitioner-company as well as respondent No.2 regarding the compromise entered. Both parties submitted that they voluntarily entered into the compromise and signed the memorandum of compromise. 7. Given the compromise entered by the parties, the terms filed along with I.A.No.1 of 2025, are made part of the record. 8. I.A.No.1 of 2025 is allowed and consequently, this Writ Petition is disposed of in terms of memorandum of compromise, setting aside the order dated 17.10.2022 in C.P.No.49 of 2022, passed by the Andhra Pradesh Real Estate Regulatory Authority, Vijayawada. SRS,J I.A.No.1 in / and W.P.No.35403 of 2022 Both parties would represent that respondents 1 and 3 are formal parties, and hence their presence is not required. The same is recorded. No order as to costs. The Registry is directed to annex a copy of the terms of compromise to this order.
