The Court:- This is an application for grant of Letters of Administration as in case of intestacy (i.e. without the Will annexed) of the estate left behind by the above named deceased. The mother of the deceased pre-deceased him. The wife died later. The deceased is survived by six legal heirs (three sons and three daughters) who have been described in paragraph 6 of the application. One of the said sons is the applicant herein. The other five legal heirs have consented to the grant by filing Affidavits of Consent. Having regard to the aforesaid and since the file has been placed before this Court by the Registrar Insolvency for grant, upon complete scrutiny by the Department, therefore, considering the view of the department the application for grant of letters of administration is allowed by passing orders in terms of prayer (a) of the petition subject to the petitioner furnishing a personal bond for a sum of Rs. 3,00,000/- (Rupees three lakh only) with one surety.
