Heard the parties
2. The petitioner has been made accused in connection with Gawan P.S. Case No. 117 of 2024 corresponding to POCSO Case No. 04 of 2025, for the offences registered under Sections 64, 96 of the B.N.S., 2023 and Sections 4, 8 of the POCSO Act and charge has been framed under Sections 64(1), 97 of the B.N.S. and Section 4(1) of the POCSO Act, pending in the Court of learned Special Judge, POCSO Act, Giridih.
3. Bail Application of the petitioner was earlier rejected by this Court vide B.A. No. 2676 of 2025 by order dated 04.04.2025.
4. Petitioner is alleged to have established consensual physical relationship with the victim who is aged about 16 years.
5. It was submitted that this is a case of adolescent love affairs between the parties. It was further submitted that the petitioner is in custody for more than a year.
6. In view of the submissions made above, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Special Judge, POCSO Act, Giridih in connection with Gawan P.S. Case No. 117 of 2024 corresponding to POCSO Case No. 04 of 2025.
