Petitioner Mr. Moyukh Mukherjee Ms. Sarmistha Basak …for the Petitioner Mr. Rana Mukherjee Mr. Dattatreya Dutta ...for the State Mr. Mukherjee, learned counsel for the petitioner submits that two persons were arrested on 24th March, 2025 from whom, 349 gms. of heroin was allegedly recovered from the possession of the principal accused and his name transpired from the co-accused statement. Though he is not FIR named, but after two months of alleged seizure, he was arrested and was taken into police custody but nothing was recovered from his possession. He is in custody for about 90 days and as such, he may be released on bail on any terms and conditions. Learned counsel for the State opposes the bail prayer contending that the investigation reveals that he is the stockiest and supplier of the narcotic substance. He further submits that several CDR was detected during investigation in between the present petitioner and the co-accused. He further 2 submits many chats, voice records, sharing of bank account through Whats App are found with the co-accused persons regarding deal of illegal narcotic substance. Having considered the submissions made on behalf of both the parties, it appears that though the petitioner is not FIR named but investigation reveals that the present petitioner fails to overcome the restrictions imposed under Section 37 of the NDPS Act, the prayer for bail made by the petitioner is rejected. Accordingly, CRM (NDPS) 992 of 2025 is disposed of. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
