2. This Court, vide order dated 01.08.2024, passed in MCRC No. 5398 of 2024, while allowing the bail to the petitioner, namely, Basant Bag & Deepak Nand had expressed its trust that the trial Court should make an earnest endeavor to conclude the trial expeditiously in accordance with law, VAIBHAV SINGH Digitally signed by VAIBHAV SINGH Date: 2025.07.22 20:15:18 +0530
2 preferably within a period of 06 months from the date of receipt of a certified copy of the order, if there was no legal impediment.
3. The learned Special Judge (NDPS Act), Saraipali District - Mahasamund (C.G.), vide his request letter dated 02.07.2025, has requested an extension of more time that IN this case, the charge sheet has been presented on 13.08.2024 and the charge has been framed in the case on 24.08.2024. After receiving the order of the Hon'ble High Court, on presenting the trial program on 03.09.2024, summons and bailable warrants were issued to the witnesses appointed for prosecution evidence on 20.09.2024, 08.10.2024, 25.10.2024, 14.11.2024, 26.11.2024, 11.12.2024, 24.12.2024, 07.01.2025, 20.01.2025, 13.03.2025, 26.04.2025. I have assumed charge as Special Judge (NDPS) on 26.03.2025. The case was first placed before me for trial on 03.05.2025. The case was fixed for prosecution evidence on 27.05.2025, 28.05.2025. Evidence of four witnesses has been recorded in the case. According to the trial program, evidence of 12 witnesses is yet to be recorded in 24 cases. The case is being conducted, but due to the absence of prosecution witnesses, evidence could not be recorded and in this case, summons/bailable warrant/arrest warrant could be issued continuously to the witnesses. The case has been again issued bailable warrants to the witnesses for prosecution evidence on 02.07.2025, 03.07.2025 and 04.07.2025 through the Superintendent of Police, Mahasamund. After recording of evidence of 12 prosecution witnesses in the case, statement of charge, final arguments and defence evidence are to be taken, due to which the case could not be resolved within the stipulated time limit as per the order of the Hon’ble High Court.
4. Therefore, further time is sought by the trial Court to conclude the trial.
5. The request appears to be reasonable. The concerned trial Court is

directed to conclude the trial as early as possible, preferably within a further period of three months from today.
6. Accordingly, this CRMP stands disposed off with the aforesaid direction.
7. Registry is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance. Sd/-
