They also claim that they have received the benefits of Banglar Awaas Yojona Scheme and initiated construction which was stalled at the behest of the police authorities. According to the petitioners, the police authorities exceeded their authority as they are not vested with the power to stall such construction and/or check the title of the records of the land. State has submitted a report which reflects that a joint inspection was carried out by the BL&LRO and the ASI of Police, Habibpur Police Station and on consultation with the local villagers, it was confirmed that the petitioners were unauthorized occupants of the government land. Although, the aforesaid contention is disputed by the learned advocate for the petitioners. Having regard to the contentions which have been canvassed, I am of the view that the police authorities have hardly any role to assess. However, the police authorities would ensure that if there are any directions passed by the BL&LRO to prevent any breach of the peace and/or tranquility, they would respect and obey such order. With the aforesaid observations, WPA 18262 of 2025 is disposed of. Pending application(s), if any, is also disposed of. Report so submitted be kept with the record.
