JUSTICE MANOJ KUMAR GARG Order 09/01/2025 The petitioners have been arrested in connection with FIR No.134/2024 of Police Station Jawar Mines, District Salumber (Udaipur), for the offence punishable under Sections 309(4), 3(5) of BNS. They have preferred this bail application under Section 483 BNSS. Learned counsel for the petitioners submits that the offences are triable by the Magistrate and similarly situated co-accused Kalu Lal has already been enlarged on bail and the case of present petitioners is not distinguishable from that of co-accused. The accused-petitioners have been in judicial custody since long and [2025:RJ-JD:1381] (2 of 2) [CRLMB-169/2025] the trial of the case will take sufficient long time to be concluded. Therefore, the benefit of bail should be granted to the accused- petitioners. Learned Public Prosecutor has opposed the bail application. Having regard to the totality of the facts and circumstances of the case, without expressing any opinion on the merits of the case, I deem it just and proper to grant bail to the accused petitioners under Section 483 BNSS. Accordingly, the bail application filed under Sec.483 BNSS is allowed and it is directed that petitioners (1) Mahendra S/o Ram Chandra & (2) Rahul S/o Ramchandra, shall be released on bail in connection with FIR No.134/2024 of Police Station Jawar Mines, District Salumber (Udaipur), provided they execute personal bond in a sum of Rs.1,00,000/- each with two sound and solvent sureties of Rs.50,000/- each to the satisfaction of learned trial court for their appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial.
