03/ 09.12.2025 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners are apprehending their arrest in connection with Complaint Case No. 1233 of 2020, registered for the offences under Section 33(i)(c) of Indian Forest Act and Section 29 of Wild Life Protection Act, pending in the Court of learned Chief Judicial Magistrate, Chatra.

Learned counsel appearing for the petitioners submits that false allegation is made against the petitioners of cultivation of poppy plant on the forest area. He further submits that even the land is not belonging to the petitioners. He then submits that in the similar circumstance, five other co-accused persons have already been

provided the privilege of anticipatory bail in A.B.A. No. 6503 of 2025 by this court.

Learned A.P.P. appearing for the State has opposed the prayer and submits that the allegations are there against the petitioners of cultivation of poppy plant in the forest area.

Considering that the land is of the forest department and the allegations are made that on the forest land the cultivation of poppy plant has been done and even the land is not belonging to the petitioners and further in the similar circumstance, five other co- accused persons have already been provided the privilege of anticipatory bail in A.B.A. No. 6503 of 2025 by this court, I am inclined to provide privilege of anticipatory bail to the petitioners.

Accordingly, the petitioners, named above, are hereby
directed to surrender before the learned court within three weeks from today, and in the event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Chatra, in connection with Complaint Case No. 1233 of 2020, subject to the conditions as laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
