IN THE HIGH COURT OF JUDICATURE AT PATNA Civil Writ Jurisdiction Case No. 15279 of 2010 ====================================================== Lalit Kumar Chetri .... .... Petitioner/s Versus The State of Bihar & Ors .... .... Respondent/s ====================================================== Appearance : For the Petitioner/s : None For the Respondent/s : Mr. D.K.Prasad, GP – 14 Mr. N.N.Ojha, Adv. ====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 4. 11-05-2017 On call, none appeared on behalf of petitioner either to press the petition or to make a prayer for adjournment. Sri Dhurjati Kumar Prasad, learned Govt. Pleader – 14 as well as Sri Nishi Nath Ojha, learned counsel for respondent/State of Jharkhand submit that on perusal of the impugned order, there is no error since the petitioner was earlier inflicted punishment in the departmental proceeding, however; after expiry of period of effect of three years, the petitioner was subsequently granted benefit of ACP. Be that as it may, since none appeared on behalf of petitioner, the writ petition stands dismissed due to non- prosecution. Anay (Rakesh Kumar, J.) U
