1. By way of the instant petition, the petitioner is challenging the action of the respondent authorities whereby the respondent authorities are not taking any action on the complaints made by the petitioner ASHUTOSH MISHRA Digitally signed by ASHUTOSH MISHRA Date: 2025.07.22 11:22:21 +0530
2 / 3 against the Respondent No.5 who has encroached the government land situated in front of petitioner’s land and constructed a residential house on account of which the easementry right of the petitioner has been affected.

Learned counsel for the petitioner would submit that the petitioner is the registered owner of landlocked property bearing Khasra No.944/2, area 0.0450 hectares and Khasra No.945, area 0.0320 hectare situated in village Amartal, Tahsil Akaltara, District Janjgir- Champa, C.G. and the Respondent No.5 has raised the illegal construction on the government land whereby the access to the petitioner has been denied. He would next contend that the petitioner has made several complaints to the different revenue authorities including the Collector, however, no action has been taken on the said complaints. Learned counsel for the petitioner would lastly submit that the respondent authorities may be directed to redress the grievance of the petitioner and may be directed to decide the representation /application of the petitioner.
3. Learned State counsel would submit that they have no objection in deciding the application/representation of the petitioner.
4. I have heard learned counsel for the parties at length and perused the documents with utmost circumspection.
5. Considering the entire facts and circumstances of the case, it is
directed that Respondent authorities i.e. the Tehsildar, Tahsil
3 / 3 Akaltara, District Janjgir-Champa shall decide the representation/application filed by the petitioner dated 01/04/2025 expeditiously as soon as possible.
