The petitioner is apprehending his arrest in connection with Seraikella PS Case No.123 of 2022, for offence registered under section 467, 406, 420, 506, 34 of IPC, pending in court of learned Chief Judicial Magistrate, Seraikella.

Learned counsel for petitioner submits that petitioner happened to be son of Krishna Kumar and Krishna Kumar is working as small-time contractor dealing in supply of scrap materials and there was a business relation of the informant with the father of the petitioner and the co- accused persons. He further submits that even not a single pie has been transferred in the account of the petitioner and the allegation is made that the informant has paid a sum of Rs.30 lacs in cash to Rajesh Kumar Mishra. He also submits that even it is not disclosed what was the purpose of giving such huge amount in cash to Rajesh Kumar Mishra. He then submits that the informant has taken two blank cheques from the co-accused persons, Krishna Kumar and Rajesh Kumar Mishra as security cheques and when the business relation turned sour, he has filled up the blank cheque to the tune of Rs.30 lacs and get them dishonoured and then made out a story that the

petitioner has taken a sum of Rs.30 lacs for managing the villagers. He further submits that in absence of filing of any case under section 138 of the Negotiable Instrument Act, 1881, the present case has been lodged. He then submits that the coaccused persons have already ben granted anticipatory bail in ABA No.5439 of 2025 and ABA No.6293 of 2025. 4. Learned State counsel opposes prayer and submits that petitioner happened to be son of Krishna Kumar. 5. Considering that the amount in question has not been paid to the petitioner and the same has been paid to one Rajesh Kumar Mishra and Krishna Kumar and the petitioner happened to be son of Krishna Kumar and two blank cheques have been taken from Krishna Kumar and Rajesh Kumar Mishra and the informant got them dishonoured and for that dishonour of cheques, the complaint case is not filed and the case of cheating has been filed and the coaccused persons have been granted anticipatory bail as aforesaid, I am inclined to grant anticipatory bail to petitioner. 6.

Accordingly, petitioner, above named, is hereby directed to surrender before learned court within three weeks from today, and in event of his surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Chief Judicial Magistrate, Seraikella, in connection with Seraikella PS Case No.123 of 2022, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
