The petitioner has filed the present writ petition challenging his posting order dated 02.06.2025 (Annexure-P/2) whereby, he has been posted from Govt. Primary School, Kenapara, Block- Khadgawan to Govt. Primary School, Gardanchuwa, Block- Bharatpur, under the rationalization instructions dated 02.08.2024. 2. Learned counsel for the petitioner would submit that the petitioner is presently posted at Govt. Primary School, Kenapara, Block- Khadgawan, which is presently comes under the Korea District, whereas he has been posted at Govt. Primary School, Gardanchuwa, Block- Bharatpur, which comes under the Manendragarh-Chirimiri- Bharatapur District, whereas the posting order of the petitioner has been issued by the District Education Officer cums District Rationalization Committee Manendragarh-Chirimiri-Bharatapur, as Kenapara comes under the District-Korea and therefore, the District Education Officer, Manendragarh-Chirimiri-Bharatapur has no jurisdiction to pass the posting order of the petitioner dated 02.06.2025. 3. On the other hand, learned counsel for the State, on instructions, would submit that earlier Kenapara, Block- Khadgawan and Gardanchuwa, Block- Bharatpur both comes under the District- Manendragarh- Chirimiri-Bharatpur which has been bifurcated in Korea District and Manendragarh-Chirimiri-Bharatpur District vide notification dated 05.12.2024. Though, Kenapara comes under Korea District and Bharatpur comes under Manendragarh-Chirimiri-Bharatpur, so far as, 3 some schools at Block- Khadgawan are concerned vide memo dated 11.04.2025 (Annexure-P/4) it has been recommended by the District Collector, Korea that the schools of Khadgawan has not been handed over to Korea District and it is still under the jurisdiction of District Education Officer, Manendragarh-Chirimiri-Bharatpur . He would also submit that vide memo dated 30.04.2025 (Annexure-P/5), a recommendation was also made to get the school of Khadgawan Block transferred to Block- Baikunthpur, Dist- Korea. He would also submit that on 30.07.2025, an instruction is received from the District Education Officer, Manendragarh-Chirimiri-Bharatpur stating therein that the 33 villages of Khadgawan Block is still not transferred to Baikunthpur, Dist- Korea and the school of Khadgawan Block is still under the District Education Officer, Manendragarh-Chirimiri- Bharatpur , therefore, the order passed by the District Education Officer Manendragarh-Chirimiri-Bharatpur is under their jurisdiction and no infirmity in there in the impugned order. 4. He would also submit the relevant instructions given by the State Government, which is being taken on record. 5. I have heard, learned counsel for the parties and perused the material annexed with the petition. 6. From perusal of the order impugned it transpires that the posting order dated 02.06.2025 (Annexure-P/2) with respect to the posting of the petitioner from Govt. Primary School, Kenapara, Dist- Khadgawan to Govt. Primary School, Gardanchuwa, Block- Bharatpur was issued by District Education Officer cums District Rationalization Committee, Manendragarh-Chirimiri-Bharatpur. Though, it appears from the 4 notification dated 05.12.2024 that Kenapara comes under the Korea District and Gardanchuha, Block- Bharatpur comes under the Manendragarh-Chirimiri-Bharatpur District, however, from the memo dated 11.04.2025 (Annexure-P/4), the District Collector, Korea has requested the Director, Public Instruction, Raipur, informing that the schools of Khadgawan Block run by the Education Department are still not handed over to the Baikunthpur Block till date, further, from the memo dated 30.04.2025 (Annexure-P/5) the Director, Public Instructions, Raipur has also informed the District Education Officer, Manendragarh-Chirimiri-Bharatpur to handed over the schools of Khadgawan Block running under the Education Department to the Baikunthpur Block, Dist- Korea. However, from the instruction dated 30.07.2025 and by the District Education Officer, Manendragarh- Chirimiri-Bharatpur, it has been clarified that till date, the schools of Khadgawan Block has not been handed over to Baikunthpur Block, Dist- Korea. 7. Considering the submissions made by learned counsel for the parties and further considering the document submitted along with the writ petition and the instructions issued by the State Government clearly reveals that the Kenapara school, Block- Khadgawan, was under the jurisdictional competence of District Education Officer, Manendragarh- Chirimiri-Bharatpur who has passed the order dated 02.06.2025 which is the order of posting of the petitioner to Government Primary School, Gardanchuwa, Block- Bharatpur. I do not find any palpable infirmity or perversity in the order impugned passed by the District Education 5 Officer, Manendragarh-Chirimiri-Bharatpur and accordingly, the present writ petition is dismissed.
