04/27.11.2025 Heard learned counsel appearing for the petitioners and learned counsel appearing for the State.
2. The petitioners are apprehending their arrest in connection with Nagar Untari P.S. Case No.98/2025, registered for the offence under Sections 126(2), 115(2), 117(2), 118(2), 109, 351(2), 352, 3(5) of the BNS and Section 3/4 of

the Prevention of Witch Craft Act, pending in the Court of the learned A.C.J.M., Nagar Untari, Garhwa.

Learned counsel appearing for the petitioners submits that the petitioners and informant are agnates and there is land dispute between them. He further submits that there are case and counter case between the parties. He then submits that both the sides have received injury. He next submits that there is general and omnibus allegation against all the accused and all the family members have been made accused.

Learned counsel appearing for the State opposed the prayer and submits that the allegation of assault is there.

Considering that there are case and counter case and the allegation is there against all the accused person and it is not clear on whose blow, the injury has been received by the informant’s side and both the sides have received injury and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioners.

Accordingly, the above-named petitioners are directed to surrender before the learned Court within three weeks from today and in the event of their arrest or surrender, they shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Nagar Untari, Garhwa in connection with Nagar Untari P.S. Case No.98/2025, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
