The petitioner has been made accused in connection with Hirodih P.S. Case No. 61 of 2025, corresponding to POCSO Case No.90 of 2025, for the offences registered under Sections 64(1), 351(2), 3(5) of the B.N.S. and Sections 4 & 6 of the POCSO Act & cognizance has been taken under Sections 65(1) of the B.N.S. and Sections 4 & 6 of the POCSO Act, pending in the court of learned Special Judge, POCSO Act, Giridih. On 12.05.2025 at about 11:30 A.M., victim had gone to a photocopy shop. The petitioner and co-accused persons took her inside the shop and raped her. It was submitted that there is delay in lodging of the F.I.R. It was further submitted that the medical report does not support the prosecution case.
