It appears from the statements of neighbours contained in the case diary that the accused abused the victim taking the name of her caste in full public view.
As a prima facie case is made out under Section 3 of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, the application for anticipatory bail cannot be entertained.
Accordingly, the same is dismissed for being not maintainable.
